1. DEFINITIONS

1.1 “Tiletoria Competition” means the promotional Tiletoria competition which is operated by the Station subject to the Rules, which provides the Participant with the opportunity to win a Prize;

1.2 “Media” means printed media, radio and television;

1.3 “Participant” means the person participating in the Competition and thus bound by the Rules;

1.4 “POPIA” means the Protection of Personal Information Act 4 of 2013; as amended

1.5 ‘‘Personal Information’’ means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to—

(i) information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;

(ii) information relating to the education or the medical, financial, criminal or employment history of the person;

(iii) any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;

(iv) the biometric information of the person;

(v) the personal opinions, views or preferences of the person;

(vi) correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;

(vii) the views or opinions of another individual about the person; and

(viii) the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person;

1.6 “Prize” means any promotion, prize draw or giveaway, any stated value of which is VAT inclusive, which is awarded to a Participant in relation to the competition;

1.7 “Processing” shall bear the meaning ascribed to it in POPI;

1.8 “Rules” means the rules contained in these terms and conditions, which incorporate and are subject to any binding rules or regulations prescribed by any law which is applicable to the Tiletoria Competition;

1.9 “Station” means Smile 90.4 FM (Pty) Ltd;

1.10 “Client” means TILETORIA CAPE (PTY) LTD

1.11 “VAT” means value added tax as defined in the Value Added Tax Act 89 of 1991

2. INTRODUCTION

2.1 The Participant acknowledges and agrees to be bound by these Rules upon entering the Tiletoria Competition.

2.2 The Station and the Client encourages the Participants to review the Rules prior to entering the Tiletoria Competition, in which the Station and the Client shall provide the Participants with reasonable opportunity to do so, and the Participants shall acknowledge that they understand and accept these Rules.

2.3 The station and the Client will not be held responsible for any data charges or phone costs incurred while participating in the Tiletoria Competition.

2.5 By entering the competition, a participant is indicating his / her agreement to be bound by these terms and conditions.

2.6 The Station and the Client reserves its rights to amend these terms and conditions from time to time.

2.7 A copy of these terms and conditions shall be made available on the Client’s website: https://tiletoria.co.za/competition-terms_conditions/. The Participant hereby acknowledges that these Rules may be amended by reasonable notification from the Station at any time during the Competition.

  1. ELIGIBILITY FOR THE ENTRY INTO AND THE WINNING OF THE TILETORIA COMPETITION

3.1 The Tiletoria Competition runs in partnership with Smile 90.4 FM on Monday the 23rd of September 2024 to Friday the 27th of September, taking place on air on Smile 90.4 FM. The activation in partnership with Smile 90.4 FM will be taking place on Saturday the 28th of September 2024. 

3.2 The QR Code Competition at the activation will be taking place on Friday the 27th and Saturday the 28th of September 2024, at the Tiletoria showroom with the address 43 Paarden Eiland Road, Paarden Eiland, Cape Town, between 08h00 am and 5h00 PM on Friday the 26th of April 2024, and 09h00 AM and 14h00 PM on Saturday the 27th of April 2024. The competition at the activation is not run in partnership with Smile 90.4 FM. The Winner will be announced on Tiletoria’s Social Media channels including Facebook and Instagram. 

3.3 Participants are required to be in possession of a valid South African identity document and a valid passport as well as reside in South Africa.

3.4 Participants are required to be at least 18 (eighteen) years of age.

3.5 Participants need to purchase an item/items to the minimum value of R2,000 at the Tiletoria showroom at Paarden Eiland as per 3.2 above. They must scan the QR code provided on site, on the 27th or 28th of September 2024 and enter their information and receipt number on the digital form, to be entered into the draw. 

3.6 Notwithstanding anything to the contrary contained in these terms and conditions, the Station and the Client reserves the right to refuse participation in the Tiletoria Competition for any reason whatsoever, provided that such right is not exercised so as to discriminate on the basis of the Participant’s race, sex, gender, sexual orientation, religious orientation or political persuasion.

3.7 No employee, no independent contractor (including any presenter), nor any immediate family member of the Station or the Client, may participate in the Tiletoria Competition.

3.8 In entering the Tiletoria Competition, the participant confirms that they are eligible to do so and indicates their agreement to be bound by these terms and conditions.

3.9 The rule is that participants may not enter this competition if they have won a prize worth R1 500.00 or more in the past 90-days with the Client or the Station. Tiletoria reserves the right to not award a prize if the consumer has won a prize prior, during the three-month window period. This also applies to consumers who provide another family member or friend’s contact details.

3.10 The competition winner is selected at random by the Client’s marketing team. Their decision is final, and no negotiation will be entered into after the fact.
